Family visas

The family visas including Partner visas, Parent visas or other family related visas.

Partner visas

Information on Partner visas

  1. 820/801 Partner Visas: The 820/801 visas are for individuals who are in Australia and wish to apply for a partner visa. The 820 visa is a temporary visa that allows the applicant to live and work in Australia while their permanent 801 visa application is being processed. The 801 visa is the permanent stage of the partner visa and provides permanent residency in Australia.
  2. 309/100 Partner Visas: The 309/100 visas are for individuals who are outside of Australia and want to apply for a partner visa to join their Australian partner. The 309 visa is a temporary visa that allows the applicant to enter and stay in Australia while their permanent 100 visa application is being processed. The 100 visa is the permanent stage of the partner visa and grants the applicant permanent residency in Australia.
  3. Eligibility and Requirements: To be eligible for these partner visas, the applicant must be in a genuine and ongoing relationship with their Australian partner, meet health and character requirements, and satisfy specific eligibility criteria. The application process involves providing evidence of the relationship, such as joint finances, shared household, and social aspects of the relationship.
  4. Application Process: The application process for these partner visas involves lodging a combined application for the temporary and permanent stages. The applicant needs to submit supporting documents, complete medical examinations, and undergo character assessments. The processing times can vary, and thorough documentation and evidence are crucial for a successful outcome.
  5. Rights and Benefits: Once granted, the temporary stage of these visas (820 or 309) allows the applicant to live, work, and study in Australia. They may also be eligible for certain government benefits and services. The permanent stage (801 or 100) grants the applicant ongoing residency and additional rights, including access to healthcare, social security, and the ability to sponsor eligible family members for permanent residency.
  6. Relationship Considerations: Immigration authorities assess the genuineness and ongoing nature of the relationship by considering factors such as cohabitation, financial interdependence, social commitment, and future plans together. The applicant and their partner must demonstrate that they have a committed and genuine relationship.
